Terms of Service - Ad-Elay

Welcome to Ad-Elay. By using the platform, you fully agree to these terms of service. Please read carefully.

1. Service Description

Ad-Elay operates a technology platform serving as a digital marketplace connecting users who want at-home beauty and grooming services ("Customers") with independent service providers ("Providers").

Ad-Elay is not a salon, beauty studio or clinic, does not perform treatments, does not employ Providers and takes no part in carrying out any treatment.

The service is available in various areas in Israel and may be expanded or restricted at the company's discretion.

2. Eligibility

Use of the platform is permitted to persons aged 18 and above only.

Providers are required to meet every legal requirement for the services they offer in Israel, including any licence, certificate, qualification or permit required by law, and appropriate insurance.

3. Customer responsibilities

The Customer is solely and fully responsible for:

  • Disclosing relevant medical information — allergies, skin sensitivities, pregnancy, or anything that could affect the treatment
  • A correct address and safe access to the place of treatment
  • A clean, well-lit and safe space for the treatment, including power and water where the service needs them

Ad-Elay does not supervise the treatment, does not inspect the products used, and is not present.

The Customer undertakes to give full and accurate information before the treatment, and bears responsibility for any damage, loss or claim arising from incorrect information, a withheld medical condition, or the conditions of the space they provided.

4. Treatments not permitted on the platform

It is strictly prohibited to offer or book through the platform:

  • Injectables, dermal fillers, botulinum toxin or any invasive procedure
  • Medical or para-medical treatments requiring a medical licence
  • Laser and medical-device treatments not permitted outside a licensed clinic
  • Use of prohibited, expired, or products not approved for use in Israel
  • Treating minors without a parent or guardian present and consenting
  • Any service prohibited under Israeli law

Ad-Elay may block users and pass information to the authorities in the event of a breach.

5. Provider terms (independent contractors)

Providers are independent contractors only and are not employees, agents or representatives of Ad-Elay.

They are fully responsible for:

  • Professional liability and third-party insurance
  • Their own equipment, tools and products, and their hygiene
  • Meeting legal and licensing requirements
  • Tax reporting and payments to the authorities

The Provider declares that they hold appropriate insurance including professional liability cover, and that they are solely responsible for any damage, loss, injury, allergic reaction, delay or other incident occurring during or following the service.

Ad-Elay bears no responsibility whatsoever for personal injury, property damage, third parties, or any incident occurring during a treatment.

6. User Conduct and Communications

When a Provider accepts a booking, the Customer and that Provider can message each other through the in-app chat. It exists only to coordinate that booking. Using the chat — and any other part of the platform — and opening an account at all, means agreeing to the following:

  • Harassing, threatening, or abusing another user
  • Hate speech, or sexually explicit, violent, or otherwise objectionable content
  • Spam, scams, fraud, or solicitation unrelated to the order
  • Sharing another person's private information, or taking the transaction off the platform to evade its safety and payment protections

Ad-Elay has zero tolerance for objectionable content and abusive behaviour. Accounts that post such content or abuse other users will be suspended or permanently removed, and we may report unlawful conduct to the authorities.

Any message can be reported from within the chat (the ⋯ menu → Report), and any user can be blocked. Reports are reviewed and acted upon within 24 hours. For any safety or content concern, contact support@ad-elay.com.

7. Contractual Relationship Between Parties

The engagement for the treatment is directly between the Customer and the Provider only.

Ad-Elay is not a party to that agreement and bears no responsibility for the performance of the service, its quality, timing or results.

8. Pricing and Payments

Prices are set and published by the Providers themselves — not by Ad-Elay. Each Provider keeps their own price list, with a price and a duration per service. The full price, including a travel fee where one applies, is itemised before you book.

The price shown at checkout is binding. Ad-Elay signs every quote cryptographically when it is issued, and the Customer is charged exactly the amount displayed. Ad-Elay applies no demand-based or surge pricing.

A booking is addressed to the Provider the Customer chose, and to no one else. There is no auction, no competing bids, and the booking is never broadcast to other Providers. The Provider may accept or decline; if it is declined or expires, the Customer chooses again.

The price may change after booking only if the Customer changes the booked services before the treatment starts. A Provider may not collect any additional amount on site beyond the booked price, and may not take payment outside the platform.

Payment is made in advance, at the time of booking.

Payouts to Providers are transferred in accordance with platform policy, after the treatment is completed.

Platform Commission

Ad-Elay charges the Provider a platform commission on each booking. The rate is set out in the terms shown to the Provider at sign-up and forms part of the agreement between Ad-Elay and that Provider; it does not affect the price the Customer pays.

For this purpose, "transaction amount" means the booking price as published by the Provider and paid by the Customer.

The commission is deducted from the total payment and used for platform operation, maintenance and development.

9. Cancellations and Refunds

Orders may be cancelled in accordance with platform policy.

Once a Provider has accepted a booking, the following applies to cancellation by that Provider:

  • Provider cancellation up to one hour (60 minutes) before the appointment starts - full waiver of the cancellation fee
  • Provider cancellation between less than one hour and 30 minutes before the appointment starts - a cancellation fee of 20% of the transaction amount
  • Provider cancellation at or close to the appointment time - a cancellation fee of 30% of the transaction amount

Ad-Elay reserves the right, at its sole discretion, to make adjustments, exceptions or credits in special cases, including cases of exceptional circumstances or force majeure.

In addition, Ad-Elay is not responsible for delays or cancellations by Providers, beyond a refund in accordance with platform policy.

10. Limitation of Liability

Ad-Elay provides a technology platform only and is not responsible for:

  • Personal injury or property damage
  • Allergic reactions or sensitivity to products
  • The outcome or quality of a treatment
  • Lateness, no-shows, or treatments not carried out
  • The conduct of Providers or Customers
  • Disputes between users

All use of the service is at users' sole responsibility.

To the maximum extent permitted by law, Ad-Elay's liability is limited to the fees actually paid for the relevant order.

11. Indemnification

Users (Customers and Providers) undertake to indemnify and hold harmless Ad-Elay, its employees, officers and representatives against any claim, damage, loss, expense or demand (including legal fees) arising from:

  • Use of the platform
  • Breach of these terms
  • The performance of treatments or their outcomes
  • Performance or non-performance of services

12. Terms Updates

Ad-Elay may update these terms at any time. Continued use constitutes agreement to the updated terms.

13. Jurisdiction

Applicable law is Israeli law. Exclusive jurisdiction is vested in the courts of Tel Aviv-Jaffa.
